A subcontractor’s workers filed a claim at the Labour Court. The claim was for a few months wages and exceeded RM100,00.00. The subcontractor claimed he was unable to pay as the Principal employer had collected the amounts due from the Headquarters of the Government Agency that had given out the contract and vanished. He was nowhere to be found after collecting the money.
A substituted notice of claim was pasted on the door of the Principal’s last known address.The claim was heard on the date stipulated in the substituted notice and an order for the full amount of wages due was made and sent to the Principal employer. The contracting Government agencies were also notified of the renegade Principal.
When word spread that he has been blacklisted and he would not be able to obtain any more work from the Government agencies, he panicked and came to the Department to appeal to be removed from the blacklist.
He paid the monies outstanding collected a letter of clearance and went on his way, promising not to delay payments in the future.
